Terms of Service

Provider (Legal Notice / Aviso Legal)
This service is operated by Aleksei Krasnoperov, a sole trader (empresario autónomo) established in Spain; full registration details (NIF and registered address) are being finalised and will be published before public launch. Contact: support@usertold.ai. UserTold.ai is an information-society service under Ley 34/2002 (LSSI-CE).
These terms govern your use of UserTold.ai ("the Service") operated at app.usertold.ai.
By creating an account, you agree to these terms.
At a Glance
- Platform fee is
$1per completed interview - BYOK provider costs are billed by your provider account
- You retain ownership of interview, evidence, and work data
- You are responsible for participant consent and lawful use
- Data is used to run the Service for you (interviews, evidence extraction, work, and integrations), and on a de-identified basis to improve our processing — see the Privacy Policy
Account
- You must provide accurate information when creating an account
- You are responsible for maintaining the security of your account
- You must be at least 18 years old to use the Service
- One person or legal entity per account
BYOK (Bring Your Own Key)
UserTold.ai uses a Bring Your Own Key model for AI providers:
- You provide your own API keys (OpenAI)
- You are responsible for your API key usage and costs with those providers
- We are not liable for charges incurred on your provider accounts
- We encrypt your keys at rest and use them only to deliver the Service
- You can delete your keys at any time from Project Settings
AI inference costs are billed separately by your provider. UserTold.ai charges a platform fee ($1 per interview) independent of AI costs.
Platform Fees
- $1 per interview — platform fee charged when an interview is completed and processed
- Prepaid credits — purchase credit packs starting at $10 (10 credits). Credits are deducted per completed interview.
- Payments are processed through Polar.sh
- All fees are non-refundable once an interview has been completed
- Credit purchases are non-refundable
Your Data
- You own all data you create through the Service (interviews, evidence, work, recordings, transcripts)
- We do not claim any intellectual property rights over your content
- We do not currently use your data to train AI models for other customers or for general-purpose use
- We use your data to improve our own interview capture/processing pipeline and prompt logic in aggregate, under role-based access controls and internal protections
- If we ever introduce training on your data, we will update these terms, give at least 30 days' advance notice, and obtain opt-in consent before any such training (or offer an opt-out where a recognised legal basis other than consent applies); we will not retroactively train on data collected before that change without consent
- You can export or delete your data at any time, subject to the deletion limits described in our Privacy Policy (encrypted backups, sub-processor propagation, and legally required retention such as billing records)

Data Use and AI Model Terms
- By default, we use Customer Data only to deliver the Service:
- Conduct interviews using your BYOK configuration
- Extract and organize evidence
- Generate work and recommendations
- Power your connected automations and project workflows
- We do not currently use interview materials, recordings, transcripts, evidence, or related feedback to train internal or third-party AI models for general-purpose use.
- We do use aggregated, de-identified processing and model-ops telemetry to improve platform algorithms, scoring, and prompts.

Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or its infrastructure
- Interfere with or disrupt the Service
- Upload malicious content through the widget or API
- Exceed rate limits or abuse the API
- Resell or redistribute the Service without permission
Participant Consent
When conducting interviews through UserTold.ai, you are the data controller for your participants' data and we are your processor:
- You are responsible for obtaining a valid lawful basis and appropriate consent from interview participants before recording
- The intake includes a consent mechanism — you must configure appropriate consent text, including explicit consent where your interviews predictably elicit special-category data (GDPR Art. 9)
- Audio and screen recording must be disclosed to participants, and where participants may be in jurisdictions that require all-party consent to record (for example California, Florida, Illinois, Massachusetts, Pennsylvania, Washington and other US two-party-consent states), you must ensure recording is lawful there
- You must comply with applicable privacy laws (GDPR, CCPA, etc.) for your participants, and must not deploy the widget to audiences likely to include children below the applicable digital-consent age (14 in Spain under LOPDGDD Art. 7)
Data Processing Agreement and Sub-Processors
- Where we process your participants' personal data, we do so as your processor under our Data Processing Agreement (DPA), which forms part of these Terms. The DPA reflects the requirements of GDPR Art. 28: we process only on your documented instructions; keep personnel under confidentiality; apply appropriate security (see Security); assist you with data-subject requests, breach notification, and impact assessments; and delete or return data at the end of the Service.
- You give general authorisation for the sub-processors listed in our Privacy Policy (currently OpenAI, Cloudflare, Polar.sh, Google, and GitHub). We will give notice before adding or replacing a sub-processor so you can object.

GitHub Integration
When you connect a GitHub repository:
- UserTold.ai creates issues on your behalf with user evidence from interviews
- Issues are labeled and linked to internal work items for tracking
- You can disconnect the integration at any time
Availability
- We aim for high availability but do not guarantee specific uptime
- The Service runs on Cloudflare Workers infrastructure
- We may perform maintenance with reasonable notice
- We are not liable for interruptions caused by third-party providers
Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranty
- We are not liable for indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid in the 12 months preceding the claim
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable mandatory law, including consumer-protection law where it applies to you. Where you contract as a consumer, your statutory rights are unaffected.
Termination
- You can close your account at any time by contacting support@usertold.ai
- We may suspend or terminate accounts that violate these terms
- Upon termination, your data will be deleted after a 30-day grace period
Changes
We may update these terms. Material changes will be communicated via email at least 30 days before taking effect. Where a change requires your consent (for example a new data-processing purpose), we will ask you to re-accept before it applies to you; otherwise, continued use after the effective date constitutes acceptance.
